Neilabeautystore reserves the right at any time after receipt of your order to accept or decline your order for any reason, neilabeautystore reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over R20000.00 (ZAR) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verification’s or information before accepting any order.

Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, neilabeautystore shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. neilabeautystore shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, neilabeautystore shall immediately issue a credit to your credit card account in the amount of the charge.

Return Policy and 7 Day Limited Guarantee

Every product you buy from neilabeautystore is backed first by the product manufacturer’s or supplier’s warranty. Neilabeautystore 7 day limited guarantee may also apply. Neilabeautystore’s 7 day limited guarantee provides for either exchange or refund of qualifying merchandise. Terms and conditions may vary by manufacturer, supplier or product. Neilabeautystore will assist customers whenever possible in gaining satisfaction with product manufacturers and suppliers.All returns require a Return Authorization number to be issued prior to being returned. Returned products must be in new condition, include original outer packaging. We reserve the right to refuse for return or charge a restocking fee for damaged, incomplete or otherwise non-conforming returns. Returns will not be accepted without a Return Authorization number issued by Neilabeautystore.

WARRANTY LIMITATIONS
There are no other express warranties or conditions respecting the equipment. Implied warranties, if any, are limited to the duration of the express warranty provided herein. Some states do not allow limitations on how long an implied warranty lasts so that the foregoing limitation may not apply to you.

LIMITATION OF LIABILITY
In no event shall Neilabeautystore or any of its subsidiaries or affiliates be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits. Some localities do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

PROCESSING TIME
Your order is thoroughly reviewed by our Credit Card Department to ensure that the order is accurate, the payment method is valid, and you are authorized to use this payment method. Once your order has passed the rigorous review by our Credit Card Department, it is sent to our warehouse for shipment.

If the item(s) on your order are in-stock, we will ship them as soon as possible from our warehouse or from one of our Distribution Warehouses located throughout the country. If the item(s) on your order are out of stock, they will not be shipped until we have received and processed the back-ordered inventory in our warehouse.

1 Overview of the PAXI Service

  1. You can select a Collection Site at the PAXI counter at any participating PAXI site.
  2. You will be requested to provide us with Your details. In this regard, your cell phone number and a valid form of identification will be requested, and You must ensure that the information provided by You is true, accurate, current, and complete in all respects.
  3. You will be required to pay for the PAXI Service in full at the point of sale at the Original Site.
  4. Once You have received a payment slip and handed it to the PAXI representative at the PAXI counter, you will be furnished with a PAXI box or PAXI flyer bag.
  5. You may place the item You intend to send into the PAXI box or PAXI flyer and once You have sealed it, you may hand it in at the PAXI counter at the Original Site.
  6. PAXI will confirm Your order by sending You an SMS confirmation together with a parcel reference number.
  7. You can track Your parcel by using Your parcel reference number at www.paxi.co.za or by phoning the PAXI Customer Care Centre or by SMS to PAXI, where after a PAXI representative will call You.
  8. PAXI will send You another SMS with an OTP and collection instructions once the parcel has arrived at the Collection Site. You will be responsible for sending the OTP and collection instructions to the Recipient.
  9. The Recipient will be required to produce the OTP at the Collection Site. PAXI will only be required to verify the OTP presented by the Recipient at the Collection Site and will not be required to verify the identity of the Recipient. Should the Recipient, for any reason whatsoever, be requested to produce a form of identification, this shall be for PAXI’s own internal records.

2 Delivery of parcels

  1. Depending on the service type chosen, delivery can take between 3 to 7 Business Days (for main centres), provided the parcel is dropped off before 15h00. For delivery to outlying or rural areas (60km or more from a main centre), the service can take between 7 to 10 Business Days.
  2. PAXI will use its best endeavours to make sure that any parcel reaches the Collection Site within the Business Days set out above. However, you confirm that time is not of the essence in relation to the delivery of any parcel. The delivery times communicated by PAXI are estimates and subject to these terms and conditions. Accordingly, PAXI will not be liable for any delay in the delivery of the parcel unless it is directly caused by PAXI or any Associated Company’s gross negligence or wilful default.
  3. Parcels will be held by PAXI for a period not exceeding 14 days from arrival at the Collection Site. PAXI will send You an SMS notification after the parcel has arrived at the Collection Site. PAXI may in its sole discretion contact You and/or send You further reminders if the parcel remains uncollected.
  4. If any parcel has not been collected after 14 days, then PAXI may return the parcel to the Original Site and inform You hereof via SMS, in which case You may be responsible for reimbursing PAXI for any costs associated with the return. Thereafter, where a parcel is not collected from the Original Site within a further 14 days, PAXI shall, at its sole discretion, be entitled to donate, store or destroy the parcel at Your risk and expense. PAXI may, in its sole discretion, retain possession of a parcel until all the charges associated with it has been paid.
  5. If the Sender has not received an SMS containing an OTP or the Recipient is unable to collect the parcel, PAXI must be notified thereof within 14 days from arrival at the Collection Point, whereafter PAXI will launch an investigation into its whereabouts.

ARAMEX

Aramex offers door to door services.

To Successfully ship your order the client should provide us with the following:

  1. Correct and working Cellphone number
  2. Correct street name&number, town name, province name and postal code.

NB: Once goods have been shipped you will be provided with a tracking number in which you can use Aramex app to track the shipment. Neilabeautystore does not have any control over Aramex delivery.

TOTAL TIME FOR DELIVERY
Total time is based on the amount of time it takes to get payment authorization, order processing, and the transit time from the carrier. This can range from 24 hours to 10 days for in-stock items.

SHIPPING AND HANDLING
Shipping and charges will be applied to all orders placed with us. If your order must be shipped in multiple boxes, or in separate shipments in the event an item is not in stock and must ship at a later date, shipping and handling charges for the entire order will be assessed at the point when the first item is shipped. We charge only ONCE for shipping for the entire order. Should you have any questions or concerns regarding these charges, feel free to email us.

Credit / Debit Card Authorizations

An authorization on a credit or debit card is a hold against your banks credit card spending limit. When the goods are shipped, a charge for the total amount of the order shipped will be sent to your credit card bank. Your bank should release the authorization when the charge is received. A charge is the only time a transfer of funds is completed; an authorization is not a transfer of funds.

Risk of Loss

If the Customer provides neilabeautystore with Customer’s carrier account number or selects a carrier other than a carrier that regularly ships for neilabeautystore, title to products and risk of loss or damage during shipment passes from neilabeautystore to the Customer upon shipment from neilabeautystore’s facility. For all other shipments, title to products and risk of loss or damage during shipment passes from neilabeautystore to the Customer upon receipt by Customer. Notwithstanding the foregoing,  neilabeautystore retains a security interest in the products until payment in full is received. Customer will be responsible for all shipping and related charges.

Dispute Resolution

AGREEMENT TO RESOLVE ALL DISPUTES THROUGH ARBITRATION OR IN SMALL CLAIMS COURT AND AGREEMENT TO WAIVE A RIGHT TO JURY TRIAL AND TO PARTICIPATION IN CLASS ACTIONS

You and neilabeautystore agree to resolve any controversy, dispute, or claim arising out of or relating to your purchase of any product or service from neilabeautystore by binding Arbitration administered by the South Africa Arbitration Association, or in a small claims court, and judgment on the arbitration award rendered by the Arbitrator(s) may be entered in a court having competent jurisdiction. This agreement to arbitrate is intended to be broadly interpreted and covers all controversies, disputes, claims arising out or relating to your purchase including, but not limited to contract claims, tort claims and statutory claims, or any combination of claims. We agree that the arbitration or small claim proceeding will take place in Durban Province .

We agree that the South Africa Arbitration Association shall administer the arbitration, and that the South African Arbitration Association’s Commercial Arbitration Rules and Mediation Procedures and Consumer Related Disputes Supplementary Procedures, if applicable, shall apply. You and neilabeautystore agree that the Arbitration Award maybe taken to a Court of competent jurisdiction to become an enforceable judgment. You and neilabeautystore agree that any arbitration under this Agreement will take place on an individual basis. Class arbitration and class actions are not permitted. If you wish to begin arbitration against neilabeautystore you must file a case with the American Arbitration Association. .

This Arbitration Agreement affects your legal rights. Arbitration is resolved by a neutral party and not a judge or jury. There is less discovery and less exchange of information between the parties to an arbitration than might occur in a court proceeding. An arbitration award is final and binding and will only be overturned or reversed by a court in very limited circumstances. You agree that, by entering into this Agreement, you and neilabeautystore are each waiving the right to a trial by jury or to participate in a class action.
